The ACT Government is committed to avoiding deaths and serious injuries from drowning incidents in home swimming pools and spas in the ACT. New rules have been introduced to protect the community by making sure that home swimming pools and spas in the ACT are fenced in accordance with current safety standards. The new rules include offences relating to maintenance of barriers and preventing access to home swimming pools and spas when not in use.

This includes in-ground and above-ground pools, temporary and permanent pools, wading pools, demountable pools, portable pools, kids’ pools and spas.
The scheme commenced on 1 May 2024 and allows all ACT pool and spa owners a four year period to make sure that their swimming pool or spa has a safety barrier that meets the prescribed safety standards and to obtain a mandatory compliance certificate. The changes that need to be made to safety barriers to make them compliant will depend on the type of safety barrier that is currently in place and the location of the swimming pool or spa in relation to other buildings, structures and boundary fences on the property. If a property is sold or rented the vendor or landlord must now disclose the status of the swimming pool and provide a compliance certificate if one has been obtained. A certificate must be obtained by an ACT Government Authorised Person for swimming pool assessment. The Arcsite team are authorised to undertake swimming pool compliance assessments. Obtaining a certificate as soon as possible will not impact the validity of your certificate as all certificates issued until May 2028 will be valid for a period of four years regardless of when they were obtained. Getting your certificate quickly will make selling or renting your property easier and may help pool or spa owners avoid rising costs for trades and materials in the event of rectification orders as the scheme progresses.

Before your inspection, you will receive a self-assessment checklist to help you decide if your pool is ready for inspection, following this review we will schedule your appointment. If the inspector determines that the safety barrier meets the required standards, a Compliance Certificate will be issued and lodged with the ACT Government (valid to 2032) $595 + gst

Where a site assessment confirms the safety barrier system is non compliant, a rectification advice report will be provided to the owner with a detailed list of works that must be completed for a certificate to be issued. $595 + gst
If rectification occurs within 6 months of the assessment report being issued, our inspector will conduct a further site visit to inspect, issue a Compliance Certificate (valid to 2032) and complete lodgements $265 + gst
When obtaining a certificate, the fees you pay cover several important costs in addition to labour, including: mandatory government lodgement fees, critical assessors insurance, and the expenses related to storing photographic and video evidence of the pool safety system. It’s crucial to ensure that you use an ACT Government “authorised person” to issue your certificate.
